What is copyright?

Copyright is essentially complete rights to an original work. Having copyright allows the author, musician, artist or other content creator to make a living based on the labor of their work. It also allows the owner of the work to decide when and how their work can be used and distributed. It also prevents others from taking their works for free or altering it in some way without the consent or permission from the original owner.


Who monitors copy right and protects the owner of the work?

In Australia there is a copyright regulation service for anyone involved in the creative process. This organisation is called APRA AMCOS. APRA AMCOS is the Australian performing rights association and the Australian mechanical copyright owners society.




What Is APRA AMCOS?

APRA AMCOS is essentially a regulation provider to ensure artists and creators get all of the rights and the recognition that is owed to them for any works that are made and even released. They also make sure any live performances of an artists work, if it is a paid performance that they receive their share of the earnings being made from their works being used in a public space.


Services they provide?

So what is it that they provide for the creator and is it worth using their service?


APRA AMCOS is a free service for all creators. If you write, compose and own songs that are performed, broadcast or recorded in some way then if you choose to join APRA AMCOS the service that you will receive includes giving permission for your original works to be used by radio/ TV stations, film makers, record companies, advertisements, websites, ringtones, pubs, clubs, restaurants, schools, TAFEs, universities, concerts and many more places.


APRA AMCOS also will collect payments from these businesses for using your music then pay you the royalties you are due.


Some of the other things that APRA AMCOS do to support the music industry include:

Professional development, this is achieved with the regular mixers and events that all members can attend. Some of these events include song writing workshops, meeting people already successful within the industry and panels and discussions about the most sort after topics in the industry. They also nurture and support future talents by hosting competitions for future writers and composers throughout the year for young people to develop their talents. They also provide grants to support local organisations, projects and events that goes to support APRA AMCOS members music.


What is performance copyright?

Performance copyright is the songwriters and the composers right to have their original works performed in a public space. This means that they have control over who plays their works live at an event, which businesses or workspace can play their works and whether their works can be used in film or advertisements and which ones. This type of copyright essentially covers the live performance or the playing of a recording of an artists work in a public space and gives the original creator the control.


What is Mechanical Copyright?

Similar to performance copyright, this type of copyright protection allows songwriters and composers the control over how their works are reproduced or copied. The mechanical copyright covers the physical copy of the work, the lyrical content, whether it is copied onto a CD or DVD and reproduced online to sell, and the recording.
